NIE Guide—U.S. Newspapers (Effective April 1, 2009 through September 30, 2010)
NIE Classroom Copies

Definition
NIE classroom circulation represent newspapers ordered by instructors teaching accredited educational classes and used in the classroom setting as part of the curriculum.
Payment
A qualifying price for all NIE copies must be paid. Payment for NIE classroom copies may be from either the school or outside sponsorship donations. For details on ABC guidelines governing sponsorship donations and examples of promotional material related to those efforts, please see the sponsorship funding section of this guide.
Other Qualification Requirements
All of the following qualification requirements must be met in addition to payment of a qualifying price.
- The teacher or other school official places an order for the copies. The order must clearly state the date(s) of delivery desired and the quantity of copies to be distributed on each date (or range of dates).
- The total number of copies classified as NIE can't exceed the number of students per classroom, per day (one may be added for the instructor). The total number of copies classified as NIE can't exceed the number of students enrolled per school, per day.
- At the conclusion of the delivery term, the teacher or school official attests to the quantity of newspapers received, dates or range of dates the newspapers were received, and the copies used in the classroom as part of the curriculum. Please see the section of the guide on affidavits.
- The copies must be distributed to instructors teaching an accredited educational class. Therefore, eligible classroom settings are those where the student is earning credit towards a diploma, certificate or degree accredited by the state or federal government. The minimum grade level acceptable is kindergarten. This includes, but is not limited to, the following:
- Grades K-12
- G.E.D. programs
- College or university classrooms
- Home schools where the parent is an accredited instructor or is a member of an accredited home school association
The following locations would not generally be considered eligible NIE classroom settings:
- Day care centers
- Head start programs (or other pre-K settings)
- Library or other general reading programs
- After-school tutoring or programs at local community centers
Newspapers delivered to ineligible classroom settings may not qualify or be classified as Educational Programs on ABC documents. However, they may qualify as third-party sales provided the program, as a whole, is compliant with all third-party guidelines.
